What Do These Charges Mean?

Assault and Battery are actually two separate charges, but often go together.

  • Assault is to cause bodily harm or “pain”.
  • Aggravated Assault is an assault with a weapon or a felony if it happens against a protected class, peace officers, elderly, a child, a disabled person, or the 2nd assault of a family member.

According to the Texas Penal Code § 22.01, et seq.

A person commits an offense if the person:

Intentionally, knowingly, or recklessly causes bodily injury to another, including the person’s spouse;

The classification of assault or aggravated assault charges range anywhere from Class C Misdemeanor all the way to First or Third Degree Felony.

Class C assaults include intentionally, knowingly, or recklessly causing bodily injury to another, including ther persons spouse; intentionally or knowingly causing physical contact with another when the person knows or should reasonably believe that the other will regard the contact as offensive or provocative.

Third Degree Felonies include assault of a peace officer, an elderly person, a child, or 2nd offence involving family violence.

No matter what type of assault or aggravated assault, this is nothing to take lightly. A criminal lawyer will help you understand your rights and fight for the best possible outcome for you in court.

What is Aggravated Assault or Assault- Family Member?

Assault and battery becomes “aggravated” when a weapon is involved or when serious bodily harm is inflicted. Aggravated assault with a deadly weapon is classified as a first degree felony where a person sustains serious bodily injury. This degree of assault and battery brings with it more serious consequences, making legal representation even more necessary to protect your rights.

Future Consequences

Besides the immediate stress and difficulty defending yourself against charges, the legal ramifications can impact the rest of your life.  Assaults involving family violence can cause you to lose your rights to possess a firearm and have permanent consequences that can negatively impact any divorce or child custody proceeding.

Hiring Your Own Criminal Defense Attorney vs. Court-Appointed Lawyer?

If you’ve ever heard the Miranda Rights (which you should have heard if you were arrested) you know that you have a right to an attorney, and that if you can’t afford one the court will appoint one for you at no charge to you. While they may have experience with a variety of criminal cases, these court-appointed public defenders are typically overworked and juggling multiple cases at once, meaning they are not as likely to invest a lot of time or focus into your case.  With dozens of cases stacking up every day, a court-appointed defender has a responsibility to get through the cases quickly and move onto the next one.
