The potential penalties reflect the seriousness with which Texas treats these allegations. A first offense for prostitution is typically a Class B misdemeanor, punishable by up to 180 days in jail and a fine of up to $2,000. Repeat offenses can escalate to a Class A misdemeanor or a state jail felony. Solicitation of prostitution is generally charged as a state jail felony, exposing the accused to 180 days to two years in a state jail facility and fines up to $10,000.
