DWI Driving While Intoxicated

Like many states, Texas has strict laws intended to protect drivers and passengers along its thousands of miles of interstates, highways, and roads.  Texas officials have passed numerous laws over the years to decrease the dangers posed by drivers taking the wheel while under the influence of drugs or alcohol.  The primary driving while intoxicated, or DWI statute, is Texas Penal Code section 49.04. Under that section, a person commits DWI if the person is intoxicated while operating a motor vehicle in a public place. 

“Intoxicated” is defined in Texas Penal Code section 49.01 as either: 

  1. Not having the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of those substances or any other substance into the body, or 
  1. Having an alcohol concentration of 0.08 or more. 

A first-time DWI, or DWI First, without aggravating factors is generally considered a Class B misdemeanor, punishable by up to 180 days in county jail and up to a 2,000 dollar fine, along with license consequences and other penalties. 

The penalties can increase when certain facts are present: 

  • Alcohol concentration of 0.15 or more can raise the charge to a Class A misdemeanor under Texas Penal Code section 49.04(d). 
  • A prior DWI conviction can increase the penalty range or elevate the charge. 
  • Two prior DWI convictions can move the case to a third degree felony under Texas Penal Code section 49.09(b). 
  • DWI with a child passenger under 15 is a state jail felony under Texas Penal Code section 49.045. 
  • Intoxication assault and intoxication manslaughter, under Texas Penal Code sections 49.07 and 49.08, carry far more severe felony penalties. 

In addition to the criminal punishments, Texas uses an administrative license suspension system through the Department of Public Safety. Under Texas Transportation Code Chapters 524 and 724, one can face an Administrative License Revocation (ALR) suspension if refusing a breath or blood test or if taking a test and the result is 0.08 or higher. 

You usually have only 15 days from the date of your arrest to request an ALR hearing. If you miss that deadline, your license can be suspended even if your criminal case is later dismissed.
